Article 1: Purpose of the General Terms and Conditions of Sale

These general conditions of sale specify the rights and obligations of Customers / Participants purchasing a product offered on the site hb-atelier-imadeit.com, of the Company Hélène Bouffard Atelier (HB Atelier), within the framework of initiation workshops to jewellery. These Workshops take place in the premises of HB Atelier and are provided by Hélène Bouffard under the name of Ateliers I MADE IT.

The booking and payment of a Workshop implies full acceptance of the General Conditions of Sale by the Client / Participant. It is therefore advisable to read the General Conditions of Sale carefully before making any reservation.

 

Terms used

“Buyer” or “Purchaser” means the person who books and pays for a Workshop for himself or for a third person.

“Workshop” means the initiation course in jewellery offered by HB Atelier on its website I MADE IT.

“Beneficiary” or “Recipient” means the natural person who receives a gift card.

“Client / Participant” means the natural person or the Beneficiary who books a Workshop for himself and who performs a Workshop.

 

Article 2: Civil liability

​

It is the responsibility of Workshop Participants to be able to provide proof of their subscription to civil liability insurance covering them during the workshop in the event they cause material or personal damage.

HB Atelier can in no way be held responsible for injuries or damage caused to the Participant or to a third party by the appropriate or inappropriate use of the equipment present in the workshop by the Participant.

HB Atelier contracted with RR Verzekeringen a professional civil liability insurance to carry out its activity.

 

Article 3: Compliance with safety and health rules

Article 3.1: Compliance with safety rules

The Participant agrees to comply with the safety instructions explained at the beginning of the Workshop:

• do not operate or use a device without having been instructed to do so and having received explanations on its operation

• do not ingest or touch any liquids or materials present in the workshop

• wear a protective visor and a breathing mask for the polishing activity

 

Article 3.2: Compliance with health rules

The Participant must cancel their participation in a Workshop if they suspect or test positive for covid-19, or if they are a contact case.

The Participant must wear a protective mask and respect the shielding measures and rules of physical distancing during the Workshop. Hydroalcoholic gel will be provided.

 

Article 4: Price, Payment terms, Payment methods

Article 4.1: Price

HB Atelier is a VAT-registered company in the Dutch chamber of commerce and apply the 21% VAT on his products and services. The prices of the Workshops offered on the website are in euros (€) and all taxes included (VAT inc.).

The current prices and their validity depend on the website updates. The prices can be modified at any time, without notice. However, no changes will apply on the prices indicated when booking the Workshops are guaranteed and cannot be subject to these changes.

 

Article 4.2: Payment conditions

All courses must be paid when booking and at least 72 hours before the scheduled date of the Workshop.

No reservation can be guaranteed if the payment has not been received by HB Atelier.

Confirmation of payment as well as confirmation of the Workshop reservation will be sent to the Client / Participant upon receipt of payment for the Workshop.

In the event of refusal of payment authorization, fraudulent payment or attempted fraudulent payment, HB Atelier reserves the right to refuse the workshop booking or to cancel it.

 

Article 4.3: Payment methods

Payment will be made by bank transfer to the HB Atelier account, the IBAN of which will be communicated when booking the Atelier.

 

Article 5: Booking a Workshop

A date and time will be proposed for the Workshop depending on the availability of the facilitator and other Workshops already organized.

Participants who do not know each other can be grouped together to form a two-person workshop. They will be guided and will follow at the same time the initiation that each has chosen when booking; the prices remain unchanged.

The Workshops can be held with a maximum of 2 Participants.

​

Steps for booking a Workshop:

After a first contact by phone or email, the Client / Participant receives, within 72 hours, by email an invoice specifying the number of people for whom the reservation has been made, the workshop (s) chosen, the date and time of the course (if determined at the time of invoicing) and the total cost (including taxes) of the course.

When the indicated amount is received by HB Atelier, the Workshop is firmly booked, and can be canceled or refunded under the conditions mentioned in article 7.

The Client / Participant will then receive, within 72 hours, a confirmation email certifying that the payment and reservation have been received.

 

Article 6: Delay

The Participant agrees to be at the scheduled time to start the Workshop.

Beyond 15 minutes late, the Workshop may be cancelled and will not be refunded.

 

Article 7: Cancellation of a Workshop

Article 7.1: Cancellation of a Workshop due to HB Atelier

For professional or personal reasons, HB Atelier may cancel a Workshop. The Participant will be notified within 48 hours, if possible. The Workshop will be fully refunded; or another date will be agreed to postpone the Workshop as the Participant wishes.

 

Article 7.1: Cancellation of a Workshop due to the Participant

Any reservation made is firm and final. If the Participant wishes to cancel it, he must contact HB Atelier 48 hours before the scheduled date of the Workshop. Beyond this period, the Workshop cannot be refunded in the event of cancellation.

HB Atelier does not guarantee that another date may be offered to the Participant.

 

Cancellation related to covid-19

The Participant must cancel or postpone the planned Workshop if:

• he tested positive

• he has symptoms

• it is contact case

The Workshop may be postponed or refunded in the event of cancellation related to covid, even cancelled at the last moment.

 

Article 8: Gift cards: "Workshop" or "Participation"

​

There are two types of gift cards.

 

The "Workshop" gift card

The Beneficiary performs the workshop chosen by the Purchaser of the gift card.

The Beneficiary can exchange the Workshop chosen by the Purchaser with one of the other Workshops offered on the I MADE IT website of the same amount. He can also choose a Workshop of a higher amount by paying the additional cost of the chosen Workshop. On the other hand, if he wishes to carry out a Workshop for a lower amount, the price difference will not be refunded but it may constitute a credit for a second Workshop carried out subsequently.

 

The “Voucher” gift card

The Beneficiary receives a credit from the Buyer for a Workshop.

The Beneficiary uses this amount to choose a Workshop; he can supplement this amount to perform a Workshop at a higher cost.

The minimum credit for a “Voucher” is 20 euros.

 

Period of validity

The “Workshop” or “Voucher” gift cards are valid for 6 months and are not refundable.

A date and a time will be proposed to the Beneficiary when he books his Workshop by contacting Hélène Bouffard.

 

Which format for your gift cards

The Buyer who offers a gift card may choose to receive:

​

• a gift card with an envelope, by post to his address or the address of the Recipient, for an additional cost of 3 euros (sent only in the Netherlands within 5 working days).

• a printable digital card, sent by e-mail to the Buyer, at no additional cost.

 

Article 9: Right of withdrawal

​

In accordance with European consumer rights legislation, the Client / Participant has 14 days to cancel their order without any specific reason.

The 14-day period starts from the day the Client / Participant booked the Workshop.

If the Client / Participant wishes the Workshop to take place before the 14-day deadline, the latter recognizes that he can only exercise his right of withdrawal within the framework of the provisions of article L. 221-25 of the Consumer Code.

 

Article 10: Protection of personal data

​

When booking a Workshop, the Client / Participant directly provides various personal data. This data may include:

  • data necessary to communicate for a booking or establish gift cards such as the first name, last name, email address, telephone, postal code of the Client / Participant or of the Workshop Beneficiary

  • the data necessary for the payment of the Workshops

 

HB Atelier collects personal data as detailed above for specific processing:

  • to get in touch with the Client / Participant

  • to ensure the follow-up of the customer relationship and the handling of disputes

  • to communicate with the Client / Participant about reserved Workshops.

 

The data collected or processed when booking a Workshop or gift cards is intended exclusively for HB Atelier, which undertakes not to communicate or use it for commercial purposes.

In accordance with applicable Regulations, HB Atelier undertakes to make its best efforts to guarantee the security of personal information collected from Clients / Participants.

Personal data may be kept by HB Atelier for a maximum period of three (3) years from the booking of a Workshop.

The maximum retention period applies unless a request for erasure is made before the expiration of this period.

 

Right of access, rectification, or deletion of personal data

CNIL declaration n ° 1335245. In accordance with the Data Protection Act of January 6, 1978, and the European General Data Protection Regulation 2016/679 (RGPD), the Clients / Participants benefit from the following rights: a right of access and rectification of their data, a right to oppose the collection and processing of their data, a right to erase their data, a right to limit the collection and processing of their data.

 

These various rights can be exercised at any time by sending a request to HB Atelier at contact@hb-atelier.com. Proof of identity may be requested by to respond to the request. It is specified that certain data may be excluded from these requests in certain circumstances, if HB Atelier must continue to process the Customer's data to serve its legitimate interests or to comply with a legal obligation.

Use of cookies

To continuously improve its performance and the browsing experience, this site uses Google Analytics, a service for measuring audience and analysing Internet user behaviour. This service involves the use of tracking cookies which make it possible to follow the path of an Internet user on the site. By continuing to browse this site, you agree to the use of these cookies.

 

Article 11: Agreement for the publication of Photos / Videos or Comments

a. HB Atelier reserves the right to authorize or not the Client / Participant to take photos / videos during the Workshop.

b. HB Atelier undertakes not to take photos / videos of Clients / Participants during the Workshop without their consent.

c. If the Client / Participant agrees to be taken in photos / video, HB Atelier undertakes to ask the latter for his agreement before any publication of these photos / videos on its website or on Instagram or Facebook or any other forms of media.

d. The published photos / video can be withdrawn immediately at the request of the Client / Participant from HB Atelier by sending an email to contact@hb-atelier.com.

The same goes for points c. and d. above for comments or testimonials written by Clients / Participant about a Workshop performed.

HB Atelier reserves the right not to publish or to withdraw certain comments or testimonials from Clients / Participants.

 

Article 12: Intellectual Property

 

The entire website and each of its constituent elements (such as trademarks, domain names, texts, trees, animation software, images, photographs, illustrations, packaging, diagrams, logos, sounds and music) are the exclusive property of Hélène Bouffard Atelier or third parties who have duly authorized Hélène Bouffard Atelier to use these elements.

No element of the Site, whether software, visual or audio, may be used, reproduced, distributed, or published in whole or in part without the prior written consent of HB Atelier.

Design Rights and Copyrights remain the sole property of Hélène Bouffard Atelier.

 

Article 10: Changes and updates

​

The terms and conditions are changed regularly, notably to take into consideration any potential regulatory changes. The new terms and conditions shall apply as of the date of their publication on the Website.

Prices are correct at the time of publication. HB Atelier reserves the right to review her prices at any time.
